1. Acceptance of Terms

By accessing or using Below, you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

2. Licence to Use

Rustpoint, LLC grants you a limited, non-exclusive, non-transferable licence to use Below for your personal, non-commercial purposes, subject to these terms:

• You may use Below solely for your own personal dive logging and site discovery.

• Commercial use of any kind — including reselling, sublicencing, or using Below data for commercial products — is not permitted.

• You may not transfer, assign, or sublicence your rights under this licence to any third party.

3. Your Content

Your dive logs, photos, and personal data belong to you. Below stores this data on your device using Apple's SwiftData and syncs through your personal iCloud account. We do not claim ownership of your personal dive data.

When you turn on Anonymous community contributions (off by default) and submit site corrections, dive conditions, species sightings, site ratings, or other contributions to Below's shared database, you grant Rustpoint, LLC a worldwide, royalty-free licence to use, display, and distribute that content to improve the app for all divers. These contributions are anonymous — they carry no personal identifier and never include your dive log. Contributed content is shared under Creative Commons Attribution-ShareAlike (CC BY-SA 4.0).

4. Disclaimers and Safety Warning

Below is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of inaccuracies. Dive site information including depth, conditions, and hazard data may be incomplete or inaccurate. Always verify conditions locally before diving.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Rustpoint, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to damages for personal injury, property damage, loss of profits, or loss of data — arising from your use of Below or any dive activity undertaken in connection with information obtained from Below. In no event shall our total liability to you exceed the amount you paid for the app in the twelve months preceding the claim.

6. Termination

We reserve the right to terminate or suspend your access to Below at any time, for any reason, including violation of these terms. Upon termination, your licence to use the app ceases immediately. You may delete the app at any time, which removes all locally stored data from your device.

7. Governing Law

These Terms of Service are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Delaware.
